CANONICA E-Boutique – General Terms and Conditions of Sale and Use
1. General Provisions – Scope of Application
1.1 These General Terms and Conditions of Sale and Use (hereinafter “GTC/GCU”) govern every sale and service offered by Canonica SA (hereinafter “Canonica”, “we”, “us”, “our”), whether via the website https://canonica.com(hereinafter the “Website”) or any other sales channel operated by Canonica. By ordering and/or using the Website or any other Canonica sales channel, the purchaser or user (hereinafter “you”, “your”) accepts these GTC/GCU without reservation.
1.2 Canonica SA is a Swiss company registered in the Commercial Register of the Republic and Canton of Geneva under company number (IDE) CHE-106.100.362.

1.3 These GTC/GCU apply to every order placed on the Website, to every service offered on the Website and to every purchase made in sales outlets operated by Canonica. They apply to the exclusion of all other terms. No special terms or any other terms originating from the customer shall prevail over these GTC/GCU without Canonica’s express written consent.
1.4 These GTC/GCU likewise apply to all purchases made from companies affiliated with Canonica SA. “Affiliate” means:
(i) any company the majority of whose voting share capital is held or controlled, directly or indirectly, now or in the future, by CANONICA;
(ii) any company that holds or controls, directly or indirectly, now or in the future, a majority of the voting share capital of CANONICA;
(iii) any company the majority of whose voting share capital is or will be held or controlled, directly or indirectly, by a company referred to under (i) or (ii).
2. Acceptance and Amendment of the Conditions
2.1 Acceptance
Placing an order via our Website constitutes full and unconditional acceptance of these GTC/GCU.
2.2 Amendments
We reserve the right to modify these conditions at any time without prior notice. The applicable conditions are those published on our Website at the time of the order or of the service’s use.
3. Products and Availability
3.1 Product Description
We endeavour to present and describe our products (chocolates, confectionery, assortments, etc.) as accurately as possible. Minor variations (e.g., packaging, visuals) may nonetheless occur without engaging our liability. All statements comply with Swiss law.
3.2 Availability
Product offers and prices remain valid while visible on the Website and subject to stock. Should an item become unavailable after your order is placed, we will inform you as soon as possible and offer either an equivalent product or a refund.
3.3 Allergies and Nutritional Information
Some products may contain allergens (milk, hazelnuts, almonds, gluten, etc.). The information on the packaging is authoritative. Please read it carefully before consumption. We cannot be held liable for allergic reactions to listed ingredients.
3.4 Product Quality
Products are crafted artisanally by professional chocolatiers in our premises in Vernier, Canton of Geneva, Switzerland. Canonica selects raw materials with great care and invests regularly to keep facilities and equipment in perfect condition.
4. Prices and Invoicing
4.1 Displayed Prices
Prices are in Swiss francs (CHF). For deliveries within Switzerland, Swiss VAT and shipping costs are included when specified on the Website or summarised in the basket.
4.2 Deliveries outside Switzerland
For orders shipped outside Switzerland, any customs duties, local VAT or similar taxes applied on arrival are the customer’s responsibility. You must enquire with the relevant authorities and pay such charges directly.
4.3 Payment Methods
Payment may be made by credit card or any other method shown on the Website. An order is validated once payment has been processed, unless otherwise agreed in writing.
4.4 Invoicing
An invoice is issued when the order is confirmed. For billing questions, please contact our customer service.
5. Ordering
5.1 Product presentation on the Website is not a binding offer but an invitation to order.
5.2 Ordering Process

5.3 By confirming the order, the customer places a firm order for the products in the basket; it can no longer be modified.
5.4 Accuracy of Data
You must enter your own data and the recipient’s address correctly. Orders to P.O. boxes cannot be processed. Canonica is not liable for delivery failures due to incorrect addresses; any resulting delays or charges are borne by the customer.
5.5 Each order is subject to Canonica’s acceptance, which may be refused for insufficient stock, incomplete customer information or any legal reason.
5.6 Receipt of order is acknowledged automatically by e-mail.
5.7 Only products paid for will be dispatched.
5.8 Sale of Alcohol
The sale of alcoholic products (wine, spirits, sparkling wine, etc.) to persons under 18 in Switzerland is prohibited. By ordering, you confirm you are authorised to purchase.
5.9 By ordering or using our services, you confirm you have read, understood and accepted these GTC/GCU.
6. Delivery – Transport – Lead Times
6.1 Packaging
Parcels are prepared by Canonica in closed, sturdy packaging suitable for the contents and transport requirements.
6.2 Carrier
Canonica ships via a high-quality carrier.
6.3 Delivery Areas
We deliver within Switzerland and internationally. For specific requests (unlisted country, special conditions), please contact customer service.
6.4 Costs and Times
Switzerland: Standard shipping costs and Swiss VAT are usually included or clearly stated. Delivery times are indicative and may vary (holidays, year-end, etc.).
International: Shipping costs (excluding duties, taxes or extra fees) are shown at checkout. Delivery times are indicative and depend on the destination and customs procedures.
6.5 Transport Risk
Goods travel at Canonica’s risk until handed to the carrier; thereafter, risk passes to you. We take great care with packaging to ensure perfect condition on receipt. Canonica is not liable for damage resulting from parcel opening during transit.
6.6 Delay or Non-Delivery
For unusual delays or problems, contact customer service promptly. Canonica is not responsible for postal, carrier or customs delays, nor for recipient absence at delivery.
7. Customs, Taxes and Formalities
7.1 Duties and Taxes
Outside Switzerland you must pay any customs duties, taxes or additional fees.
7.2 Compliance with Local Regulations
You must comply with the laws of the destination country. We accept no liability for breaches of local regulations.
8. Right of Withdrawal, Returns and Refunds
8.1 Right of Withdrawal
Because our products are perishable, the right of withdrawal may be limited or inapplicable under local law. Swiss law does not systematically grant a return right for foodstuffs.
8.2 Returns
If a product is damaged or non-conforming, contact customer service in writing within 48 hours of receipt, with photos and description. We will offer the best solution (replacement or partial/full refund). After this period no claim will be considered.
8.3 Refunds
Refunds are made using the original payment method unless agreed otherwise; processing times depend on the payment provider.
9. Liability
9.1 Use of the Website
The Website is provided “as is” without guarantee of availability. Canonica is not liable for damages (data loss, intrusion, viruses, etc.) arising from use of the site.
9.2 Force Majeure
We accept no liability for failure to perform due to force majeure (natural disasters, war, strikes, transport stoppages, IT failures, government decisions, etc.).
9.3 Disclaimer of Warranty
We do not warrant that products will meet expectations beyond the information on the Website or packaging. Contact customer service for personalised advice.

These GTC/GCU are governed by Swiss law to the exclusion of conflict-of-laws rules.
12.2 Jurisdiction
Any dispute relating to these conditions shall fall under the exclusive jurisdiction of the courts at Canonica’s registered office, subject to appeal to the Federal Supreme Court.
13. Final Provisions
13.1 Entire Agreement
These GTC/GCU constitute the entire agreement between you and Canonica concerning product purchases and Website use.
13.2 Severability
If any clause is declared null or unenforceable, the remaining provisions remain in force.
